*sigh* Please search the archives of NANOG (the North American Network
Operators Group) or inet-access.  This thread has been beaten to death on
both lists.  A google search on "isps are not common carriers" should help.

There's still a lot of distinction from the "telecommunications common
carrier" defined by the FCC ... which means that the ISP basically has no
control over what use its server is put to.
